Welcome to StackGrader. By using our service, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using StackGrader ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

StackGrader is an AI-powered grading assistant that helps educators grade student work. The Service transcribes handwritten submissions, suggests scores based on rubrics, and drafts feedback—all subject to teacher review and approval.

3. Account Registration

To use StackGrader, you must create an account and provide accurate information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Educational Use and Compliance

If you use StackGrader with student work, you represent and warrant that:

  • You have appropriate authorization to upload and process such student work
  • Your use complies with all applicable laws, including but not limited to FERPA, COPPA, and state privacy laws
  • Your use complies with your institution's policies regarding student data and third-party services
  • You have obtained any necessary consents required by your institution or applicable law

StackGrader provides tools for privacy-conscious grading (including ID-only mode and data retention controls), but compliance with educational privacy laws remains your responsibility as the educator.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that infringes on intellectual property rights
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service to harass, abuse, or harm others
  • Interfere with or disrupt the Service or servers
  • Reverse engineer or attempt to extract source code from the Service

6. Intellectual Property

You retain ownership of all content you upload to StackGrader. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

StackGrader and its original content, features, and functionality are owned by StackGrader and are protected by copyright, trademark, and other intellectual property laws.

7. AI-Generated Content

StackGrader uses artificial intelligence to transcribe handwriting, suggest scores, and draft feedback. You acknowledge that:

  • AI-generated suggestions are not guaranteed to be accurate
  • You are responsible for reviewing and approving all grades and feedback before they are finalized
  • The final grading decision always rests with you, the educator

8. Privacy and Data

Your use of StackGrader is also governed by our Privacy Policy. We are committed to protecting your data and never sell or share it with third parties for advertising.

Student work is processed to provide the Service but is not used to train AI models.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time with reasonable notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACKGRADER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless StackGrader and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service for violations of these Terms or for any other reason with notice.

Upon termination, your right to use the Service will cease. You may request deletion of your data in accordance with our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Michigan, without regard to conflict of law principles.
